Is this a merger or just photographically close? I classified it as a non-merger.

By "overlap" I understand you to mean non-merging, just overlapping images in different planes. Correct?

3 dots are distant galaxies don't see any merger activity but a lovely dust lane

don't see any perturbation indicating a merger. overlap IMHO
