It is hard to decide. It could be a galaxy with 2 nuclei, so a post-merger, or it could be an overlap. There are no strange colours which would indicate a merger. There is a spectrum which shows no AGN activity, so I would say overlap.

In SDSS there is also a spectrum available for the 2nd nucleus! It is a merger, because the redshifts of both nuclei are nearly identical.
